Terms and conditions for the use of the platform

By accessing and using the Credsol platform ("Platform"), operated by Credit Solutions and Financial Edge Limited ("Company," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and the Company governing your use of our AI-powered credit marketplace platform.
If you do not agree to these Terms in their entirety, you must not access or use the Platform. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on the Platform. Your continued use of the Platform after any such modifications constitutes your acceptance of the updated Terms.
Credsol is an AI-powered credit marketplace platform designed to facilitate connections between businesses seeking financial products and qualified lenders. Our platform utilizes artificial intelligence and machine learning algorithms to analyze business profiles, financial data, and credit requirements to provide pre-qualification assessments and match businesses with appropriate lending solutions.
The Platform offers services including but not limited to: business loan pre-qualification, credit card recommendations, equipment financing options, working capital solutions, commercial mortgage services, expansion financing, and invoice financing. We act as an intermediary platform and do not directly provide loans or financial products ourselves.
To use the Platform, you must be at least 18 years of age and have the legal capacity to enter into binding agreements. If you are accessing the Platform on behalf of a business entity, you represent and warrant that you have the authority to bind such entity to these Terms and that the entity meets all eligibility requirements.
Registration on the Platform requires you to provide accurate, current, and complete information about yourself and your business. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.
We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion if we determine that you have violated these Terms or engaged in fraudulent, illegal, or inappropriate conduct.
You may use the Platform solely for lawful purposes and in accordance with these Terms. You agree not to use the Platform in any way that violates any applicable federal, state, local, or international law or regulation, or to transmit or facilitate the transmission of any material that is defamatory, obscene, threatening, or otherwise objectionable.
You are prohibited from attempting to gain unauthorized access to the Platform, its servers, or any computer systems or networks connected to the Platform. You may not use any automated means, including robots, spiders, or other data mining tools, to access, monitor, or copy any content from the Platform without our prior written consent.
You acknowledge that the Platform's AI algorithms and matching services are proprietary to the Company and constitute valuable trade secrets. You agree not to reverse engineer, decompile, or otherwise attempt to extract the source code of any software used in connection with the Platform.
The Company operates as a technology platform that facilitates connections between businesses and lenders. We do not directly provide loans, extend credit, or make lending decisions. All lending decisions, terms, and conditions are determined solely by the individual lenders with whom you may be matched through our Platform.
Pre-qualification assessments provided by our AI system are estimates based on the information you provide and are not guarantees of loan approval or specific terms. Actual loan offers may differ significantly from pre-qualification estimates due to factors including but not limited to: lender-specific criteria, market conditions, credit score changes, and additional verification requirements.
We do not guarantee the accuracy, completeness, or timeliness of any information provided through the Platform. You acknowledge that financial products and lending criteria are subject to change without notice, and you should independently verify all terms and conditions with the actual lender before proceeding with any financial transaction.
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.
You acknowledge that to provide our services, we may need to share your information with potential lenders and other third-party service providers. You authorize us to transmit your information to such parties for the purpose of facilitating loan applications and related services.
The Platform and its entire contents, features, and functionality, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by the Company, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Platform, except as follows: your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials, and you may store files that are automatically cached by your web browser for display enhancement purposes.
To the maximum extent permitted by applicable law, the Company, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Platform or any financial transactions facilitated through the Platform.
In no event shall the Company's total liability to you for all claims arising out of or relating to these Terms or your use of the Platform exceed the amount paid by you, if any, for accessing the Platform during the twelve (12) month period preceding the event giving rise to the claim.
The limitations set forth in this section will not limit or exclude liability for personal injury or property damage caused by the Company's gross negligence or intentional misconduct, or for any other liability that cannot be excluded or limited under applicable law.
You agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms, your use of the Platform, or your violation of any third-party rights.
The Company reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with the Company's defense of such claims.
These Terms are effective until terminated by either party. You may terminate your account and these Terms at any time by discontinuing your use of the Platform and notifying us in writing. We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the Platform will cease immediately. The provisions of these Terms which by their nature should survive termination shall survive termination, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated, without regard to its conflict of law provisions.
Any legal suit, action, or proceeding arising out of or relating to these Terms or the Platform shall be instituted exclusively in the federal courts or state courts located in the jurisdiction where the Company is incorporated, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.
These Terms constitute the entire agreement between you and the Company regarding the use of the Platform and supersede all prior agreements and understandings, whether written or oral, relating to such subject matter.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. The Company's failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
You may not assign or transfer these Terms, by operation of law or otherwise, without the Company's prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. The Company may freely assign or transfer these Terms without restriction.
